RENTAL AGREEMENT for BEAR'S BUNGALOW
(Including policies and procedures)
K. C. Rentals has developed the following policy and procedures for the rental of the Bear’s Bungalow, located in Wear’s Valley (Sevierville, Pigeon Forge) Tennessee. These policies and procedures were developed for the benefit of all of our guests.
K. C. Rentals reserves the right to refuse rental to any person or persons in the best interest of the cabin. Even though we try to be correct on all paperwork, K. C. Rentals will not be responsible for errors on confirmations, e-mail, etc., please notify us if there are errors.
As a guest of K. C. Rentals/Bear’s Bungalow, I/We agree to the following:
**NO SMOKING IN CABIN OR THE GAMEROOM; Smoking inside the cabin and/or the gameroom is PROHIBITED. Both are NON-SMOKING. If this regulation is violated and smoking has been detected in either place, a $150 penalty will be charged to your credit card. Smoking outside on the decks is not a problem but be sure to use ash trays and not the porch floor or yard for disposing of cigarettes/cigars. You will be charged an additional $150.00 for cleaning yard if cigarette/cigar butts are found not disposed of properly after your rental period.
**NO ILLEGAL DRUGS ALLOWED. Should drugs be found on property and/or in registered guest or a visitor of registered guest’s possession, all guests will have to leave without refund.
**NO DRUNKEN OR DISORDERLY CONDUCT.
**NO LEWD OR OBNOXIOUS BEHAVIOR.
**NO EXCESSIVELY LOUD MUSIC.
**ABSOLUTELY NO PETS OF ANY TYPE ALLOWED ON PREMISES. We cannot control neighboring or wildlife animals. If pets are discovered, all guests will be asked to leave without a refund and there will be an automatic charge of $500.00 for extra cleaning due to pet dander, possibly fleas, etc.
**NO FIREWORKS OR FIREARMS ALLOWED.
Fireplace is closed between May 1st and August 31st.
Property rules and regulations
Please read all rules and regulations governing the use of the property you are staying at. These rules apply to owners and guests; failure to comply can result in eviction. If evicted for not following the rules it will result in forfeiture of all rental payments and deposits
Reserving Guest(s):
Must be 25 years of age or over and have a major credit card (Visa, MasterCard or Discover only) in his/her name to rent our cabin. Guest making reservation must be staying in cabin as well unless authorized in writing by K. C. Rentals.
We will not rent to vacationing students or singles under 25 years of age. No un-chaperoned groups. Absolutely no house parties, youth groups, fraternities, sororities, weddings, receptions, meetings, or parties allowed. K. C. Rentals does not rent to students or groups of students under any circumstance, even if a parent or legal adult makes the reservation and/or pays the rent. If such a group attempts to occupy one of our rental properties, all monies will be forfeited and guests will be asked to vacate the property immediately.
Be sure to bring your calling card, credit card or cell phone because telephone is blocked out for direct long distance calls.
Rates and Deposits:
Rates and terms are subject to change without notice. All rates are in US dollars.
Credit cards that we accept are Visa, MasterCard and Discover only.

***Late check outs are not available unless requested in writing 30 days prior to scheduled check in date. Additional charge may apply. Late check out without authorization will be charged as an additional night’s rent. NO EXCEPTIONS!
OFF SEASON: $109.00 PER NIGHT
(2 NIGHT MINIMUM)
MID SEASON: $139.00 PER NIGHT
(2 NIGHT MINIMUM)
HIGH SEASON: $169.00 PER NIGHT
(3 NIGHT MINIMUM)
HOLIDAYS: $199.00 PER NIGHT

Published rates are based on occupancy of 1 – 4 guests (adults and/or children)
There is an additional charge of:
$12.00 plus tax per adult (13 and up) per night,
$ 7.00 plus tax for children (3-12) per night.
$ No additional charge for children under 3
Tax rate is 9 ½% and is charged on all that is applicable.
Deposit: 50% of the rental fee will be due at the time of reservation. The balance is due 30 days prior to check-in by credit card or check unless otherwise noted. Should payment be made by check, reservation will be cancelled if check is returned for any reason and your deposit will be forfeited. Your reservation will be held for 10 business days (from booking) pending receipt of payment and signed rental contract. Payment must be made by credit card or check. If not received in the time frame specified, your reservation will be cancelled. Balance is due in full 30 days prior to arrival. If booked less than 30 days prior to your arrival date, payment will be due in full (including taxes) at the time of booking. Any damage other than normal wear will be charged to your credit card. A detailed receipt will be sent to you via email or postal mail after your departure.
The rental property may not be a sublet. Your reservation is not transferable to any other party.
There will be NO check ins on major holidays, Thanksgiving, Christmas, New Year’s etc.
OTHER CHARGES AND FEES:
All changes made at least 31 days prior to arrival will incur a $25.00 Change Fee. No changes can be made on reservations that are 30 days or less scheduled check in date
A Reservation Fee of $0.00 will be added to each reservation for administrative costs and the processing of your reservation.
A Fee of $35 or 5% (whichever is greater) of check will be charged for all returned checks.
Refunds and Cancellations:
You may cancel your reservation up to 31 days prior to check in date and receive a full refund less a $75 administrative/cancellation fee. If you cancel your reservation less than 30 days prior to your scheduled check in date, there will be no refund.
You are encouraged to purchase travel insurance in case of unforeseen emergencies. (www.insuremytrip.com, www.travelguard.com and www.travelinsure.com are just a few of them on the internet).
There are no refunds for weather conditions, early departures, power outages, unforeseen mechanical failures or acts of God.
Maintenance Emergency Number:
You will find emergency numbers posted on the side of the refrigerator in cabin. Examples of emergencies: no heat, no water, broken pipes, etc. Maintenance issues, such as problems with cable TV, hot tub, non-emergency plumbing problems, etc, please call (239) 229-4838 between the hours of 8:00 am and 9:00 pm (Eastern Time). Please leave a message if we are not in; we check for messages often. Maintenance will then call you to schedule a visit so it doesn’t interfere with your vacation.
Please do not leave windows or doors open if the heater or the A/C is operating.
Key Policy
Make sure all doors to the property are locked when you are not at the property. Any lost key will result in a charge paid by guest for re-keying the entire rental property by a professional locksmith. If you lock yourself out of the cabin, please call the maintenance number. A lock out fee of $100.00 will be charged to you.
All keys to the rental property must be returned to original lockbox after all door and deadbolts are locked at the time of your departure (as stated in check-out procedures).
Security of Personal Property.
K. C. Rentals is not responsible for any acts of vandalism or theft, or other damages to personal property or for personal items left by a guest in the rental property during and after check out.
ACCIDENTS:
Guest agrees to hold K. C. Rentals / Bear’s Bungalow Cabin harmless for any accident or injury whatsoever that may occur on the rental property during occupancy.
Hot Tub and Cover:
Pregnant women and persons with heart conditions or skin sensitivities should not use the hot tub. Hot tub is not recommended for children under the age of 18 (use of hot tub is at the discretion of parent/guardian)
If you notice a slight discoloration of water, brown film or small black specks in bottom of tub, it is due to the minerals found in well water. We assure you it is clean and the chemicals are balanced. Hot tub is to stay covered at all times when not in use. Be sure to turn off jets as well. This helps keep the temperature of water regulated and prevents damage to the pump. THE JETS DO NOT TURN OFF AUTOMATICALLY.
ABSOLUTELY NO OILS, SOAPS, BUBBLES, FOOD OR ALCOHOL ALLOWED! Hot tubs are inspected after each rental. If any items such as food, alcohol, soaps, etc. are found in the hot tub you will be charged and additional $150.00 fee for excessive cleaning.
STAY OFF OF CLOSED HOT TUB COVER AND DO NOT PLACE ANY OBJECTS ON COVER. You will be charged $550.00 for replacement of hot tub cover if damaged. Hot tubs are drained and filled on a regular basis. Upon check in, should your water feel cool or just slightly warm, it is in the process of heating.

By the signature below, I/We have read and agree to the policies and procedures stated above and am/are authorizing K. C. Rentals (owner) of my/our intent to rent Bear’s Bungalow. I/We also authorized K. C. Rentals/Kelly Tuttle (owner) to charge my/our credit card for this rental as outlined in the Rental Agreement.
